30-Day Comment Period Starts Tuesday, May 23 for Sewer Ordinance

The City of Kalamazoo has submitted proposed changes to Chapter 28 of the Code of Ordinances, pertaining to wastewater discharge regulations and enforcement. A public comment period for this modification will open on May 23, and comments received will be considered in the final decision by State regulators.
The proposal would update wastewater discharge limits for certain pollutants and add limits for additional pollutants. Changes would also improve definitions for terms within the ordinance and add requirements for companies to follow in the event of an accidental discharge into the system. Enforcement language would be improve for the Industrial Pre-treatment Program as well, including Administrative Reviews and Appeals.

The City of Kalamazoo (Kalamazoo) and the Michigan Department of Environment, Great Lakes, and Energy (EGLE) are conducting this joint public notice and publication in accordance with Michigan Administrative Code R 323.2308.
Kalamazoo has submitted proposed modifications to its previously approved and operating Industrial Pre-treatment Program (IPP) found in its Sewer Use Ordinance, Chapter 28 of Kalamazoo’s Code of Ordinances, Local Limits and Special Allocation Procedures. EGLE has reviewed the request and determined it is a substantial program modification as defined in Title 40 of the Code of Federal Regulations, Section 403.18, and R 323.2309 of the Michigan Administrative Code.

Comments or objections to the proposed modifications to Kalamazoo’s IPP that are received within 30 days from the date this notice is published will be considered in the final decision. If no substantive comments are received, no further notice will occur, except as generally provided by the City of Kalamazoo for the introduction of amended ordinances. Any request for a hearing should be sent to the State IPP Coordinator at EGLE, P.O. The request for a hearing should include: the reasons why a hearing is being requested, identity of the relevant issues, and specifically which portions of the proposed modified IPP are of concern.
