These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Kalamazoo.
REQUEST FOR RELEASE OF FUNDS
On or about October 14, the City of Kalamazoo will submit a request to the HUD Michigan State Field Office for the release of HOME Investment Partnerships Program (HOME) funds under Consolidated Appropriations Act, 2023 (Public Law 117-328), to undertake a project known as the Legacy Senior Independent Living Project to support the construction of 70 new residential units to be made available to households age 55+. Two, three-story building will be constructed in the northwest portion of the site containing 36 one-bedroom units with a second three-story building to be constructed in the southeast portion of the site containing 34 one-bedroom units. Asphalt covered drives/parking areas will occupy the majority of the remainder of the property with landscaped lawn space in the northeastern portion of the site. A series of storm water infiltration areas are anticipated adjacent to the two buildings and beneath the asphalt covered parking area between the two buildings. The Project will provide safe, decent, accessible, and affordable housing for the City of Kalamazoo's underserved, older community members. The Project is estimated at $27,000,000, including $500,000 in HUD HOME funds.
FINDING OF NO SIGNIFICANT IMPACT
The City of Kalamazoo has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Kalamazoo Community Planning and Economic Development Department, located at 245 N. Rose Street, Suite 100, Kalamazoo, MI 49007 and may be examined or copied weekday’s from 8:00 A.M to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Kalamazoo Community Planning and Economic Development Department (CPED). All comments received by October 14 will be considered by the City of Kalamazoo prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Kalamazoo certifies to HUD Michigan State Field Office that Antonio Mitchell in his capacity as Director of the City of Kalamazoo CPED, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD Michigan State Field Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Kalamazoo to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City of Kalamazoo’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Kalamazoo; (b) the City of Kalamazoo has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U. S. Department of Housing and Urban Development –Detroit Field Office, Keith E. Hernandez, Director, Community Planning and Development at 477 Michigan Ave, Suite 1600, Detroit, MI 48226 or DetroitCPD@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
