NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS

On or after October 6, 2025 the City of Kalamazoo will submit a request to the HUD Detroit Field Office for the release of PY2025 CDBG and HOME funds under Title I of the Housing and Community Development Act of 1974 (Public Law 93-383), as amended, and under the Cranston-Gonzalez National Affordable Housing Act of 1993 to undertake the following projects and activities: 

Tier 1 Broad Review Project/Program Title: Community Homeworks Critical Home Repair 

Purpose: The critical repairs undertaken by Community Homeworks often prevent families from facing housing insecurity and displacement due to condemned status or uninhabitable and unsafe living conditions.  

Location: City-wide in CDBG-eligible census tracts 

Project/Program Description: Community Homeworks Critical Repair Program helps low-income homeowners with health and safety issues within their lived environment. The critical repairs often prevent families from facing housing insecurity due to uninhabitable or unsafe conditions. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known. 

Level of Environmental Review Citation: 24 CFR Part 58.35(a)(3) 

Tier 2 Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 [42 USC 4001-4128 and 42 USC 5154a], [24 CFR 50.3(i) & 58.5(i)(2)](HUD Standard), (Above-Ground Tanks)[24 CFR Part 51 Subpart C], [Executive Order 11988, particularly section 2(a); 24 CFR Part 55], [National Historic Preservation Act of 1966, particularly sections 106 & 110; 36 CFR Part 800] 

Mitigation Measures/Conditions/Permits (if any):  

Flood Insurance: The project will not involve properties located in a FEMA-identified Special Flood Hazard area. Before any projects move forward FEMA flood maps that went into effect February 17, 2010 will be consulted and documented in a Site Specific Tier II Environmental Review Checklist. FEMA Floodplain Map Portal: http://msc.fema. gov. The City also participates in FEMA National Flood Program. 

Contamination and Toxic Substances: Compliance is established by conducting a visual inspection of the site to determine if there are visible dumps, landfills, industrial sites or other locations containing or releasing toxic/hazardous, radioactive materials, chemicals or hazardous wastes on or near the site. The EGLE website is utilized to determine if any Leaking Underground Storage Tanks are present. This is documented in a Site Specific Tier II Environmental Review Checklist. 

Project is located in Kalamazoo County, which CDC data shows that more than 10 tests have been conducted over the last 10 years. The average of the 3,261 tests completed in the county over a ten-year period are 3.7 pCi/L. 

Explosives and Flammable Hazards: The project will not involve properties located within the acceptable separation distance of an explosive or flammable hazard. Staff will conduct a review of aerial maps and an onsite inspection of nearby properties to identify explosive and flammable hazards and will calculate the ASD for each to ensure compliance. ASD calculations will be documented in the Site Specific Tier ii Environmental Review Checklist. 

Floodplain Management: The project will not involve properties located in a FEMA-identified Special Flood Hazard area. Before any projects move forward FEMA flood maps that went into effect February 17, 2010 will be consulted and documented in a Site Specific Tier II Environmental Review Checklist. Tier 1 Broad Review Project/Program Title: KNHS Critical Home Repair Roof Replacement 

Purpose: When a roof deteriorates, the quality of housing declines rapidly, causing a wide variety of structural, environmental, and quality of life issues. 

Location: City-wide in CDBG eligible census tracts. 

Project/Program Description: Kalamazoo Neighborhood Housing Services (KNHS) Roof Replacement Program will provide grants and/or loans, depending on the household's area median income, to replace roofs. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Tier 1 Broad Review Project/Program Title: Milestone Senior Services Critical Minor Home Repair 

Purpose: These small repairs will help ensure that homeowners over the age of 60 with low income can remain living safely and independently in their homes.  

Location: City-wide in CDBG eligible census tracts 

Project/Program Description: Milestone Senior Services Senior Home Repair Program provides critical and accessibility home repairs specifically to senior households. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Tier 1 Broad Review Project/Program Title: KNHS Community Housing Development Organization 

Purpose: In the aftermath of the 2008 housing market crash, the Northside Neighborhood experiences the largest volume of single-family home demolitions in the City of Kalamazoo. This project will replace homes lost on Woodbury St and Ada St that were demolished over the past 20 years.  

Location: Ada/Simpson area of the Northside Neighborhood, specific addresses will be assessed in the site-specific reviews. 

Project/Program Description: KNHS Community Housing Development Organization (CHDO) Project - Infill Single-Family New Construction and/or Whole House Rehabilitation Program will work within the Ada/Simpson area of the Northside Neighborhood. KNHS plans to build three new homes on vacant scattered lots and renovate two properties.  

Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Tier 2 Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 [42 USC 4001-4128 and 42 USC 5154a], 24 CFR 50.3(i) & 58.5(i)(2)(HUD Standard), (Above-Ground Tanks)24 CFR Part 51 Subpart C, Executive Order 11988, particularly section 2(a); 24 CFR Part 55, National Historic Preservation Act of 1966, particularly sections 106 & 110; 36 CFR Part 800, Noise Control Act of 1972, as amended by the Quiet Communities Act of 1978; 24 CFR Part 51 Subpart B, Executive Order 12898

If yes, The EGLE website will be utilized to determine if the property is within 1 mile of any visible, explosive- or flammable-substance container and the appropriate ASD for both blast overpressure and thermal radiation will be calculated. This is documented in the Site Specific Tier II Environmental Review Checklist.

Noise Abatement and Control: Staff will conduct a review of each project to determine the extent to which the property is affected by Noise from the local airport, railroads, and major roadways. This noise review is included in the Site Specific Tier II Environmental Review Checklist. Staff will consult maps that show a 3,000ft buffer around railroads, a 1,000ft buffer around major roadways, and a buffer that shows the 65 DNL Zone around the local airport. For properties that are inside one or more of the buffers a noise study will be conducted using the HUD DNL calculator at https://www.hudexchange.info/environmental-review/dnl-calculator

Environmental Justice: Acquisition of vacant property for future redevelopment is generally considered beneficial because it returns the property to productive use and reduces blight. Potential exceptions could arise if a property is not located in an area where a low- or moderate-income buyer would thrive or where the continuation of the property as a residence is not consistent with the City Master Plan. Staff will review each property to ensure acquisition has no adverse environmental impacts.

Tier 1 Broad Review Project/Program Title: Kalamazoo Valley Habitat for Humanity Critical Home Repair 

Purpose: This program will help residents remain safe in their homes, preserve the existing affordable housing stock, and the prevent the displacement of vulnerable families. 

Location: City-wide in CDBG eligible census tracts. 

Project/Program Description: Kalamazoo Valley Habitat for Humanity (KVHH) Critical Home Repair Program addresses urgent health, safety, and accessibility concerns for low-income owner-occupied households. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.35(a)(3) 

And 24 CFR Part 58.35(a)(4). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at City of Kalamazoo Community Planning and Economic Development, 245 N Rose St, Suite 100, Kalamazoo, MI 49007 and may be examined or copied weekdays 8 A.M to 3P.M. or at 

 

Public Comments 

Any individual, group, or agency may submit written comments on the ERR to the City of Kalamazoo Community Planning and Economic Development, 245 N Rose St, Suite 100, Kalamazoo, MI 49007 attention: Alex Hoffmann-Zobel. All comments received by October 6, 2025 will be considered by the City of Kalamazoo prior to authorizing submission of a request for release of funds. 

Environmental Certification

The City of Detroit certifies to HUD that Antonio Mitchell, Certifying Officer, in his capacity as CPED Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the grant recipients listed above to use HUD program funds. 

Objections to Release of Funds

HUD will accept objections to its release of fund and the City of Kalamazoo’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Kalamazoo; (b) the City of Kalamazoo has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Detroit’s Field Office, Keith E. Hernandez, Director, Community Planning and Development at 477 Michigan Ave, Suite 1600, Detroit, MI 48226 or at Environmental-PublicComments@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
